Agreement to Terms

By accessing and using NotiQ ("Service"), provided by 2MTN AB, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

Description of Service

NotiQ is an AI-powered outreach platform that helps you find business leads, generate personalized outreach content, and send email campaigns from email accounts you connect (including Gmail, Outlook, IMAP/Email, and other providers we may support). Depending on how you use the Service, this may include retrieving public business listing information for lead discovery, importing or managing prospect data, creating AI-assisted email copy, sending outreach through your connected inboxes, and tracking replies and engagement in the NotiQ inbox, optionally syncing NotiQ-managed labels to Gmail where available, and optionally appending your mailbox send-as signature to outbound messages when you enable those options on an agent.

NotiQ is designed as a productivity tool for authorized business outreach. You are responsible for ensuring your use of the Service complies with applicable laws and the policies of any third-party services you connect, including Google, Microsoft, and other email providers.

Acceptable Use Policy

You agree to use the Service responsibly and in compliance with all applicable laws, including anti-spam, privacy, and marketing regulations. You must not:

• Send spam, unsolicited emails, or engage in outreach without a lawful basis or appropriate consent where required
• Violate applicable anti-spam or marketing laws (such as CAN-SPAM, GDPR, or equivalent local rules)
• Use the Service for illegal activities, fraud, harassment, or deceptive practices
• Attempt to reverse engineer, hack, or compromise our systems or connected third-party services
• Share your account credentials or connected mailbox access with unauthorized users
• Collect or use personal data about prospects or recipients without a lawful basis and appropriate notice where required
• Send threatening, abusive, or inappropriate communications
• Use the Service in a way that violates Google's terms, policies, or API restrictions, including the Google API Services User Data Policy
• Misuse Gmail or other connected accounts, exceed reasonable sending limits, or engage in conduct that may harm sender reputation or violate provider policies

You are solely responsible for the content of emails you send through NotiQ, your recipient lists, and providing appropriate notice to recipients about your outreach and any tracking you enable, where required by law.

Sender Responsibility and Legal Compliance

You are the sender

You are the sole sender and initiator of every message created, scheduled, or sent through NotiQ, whether you send it manually or through AI agents, automation, or other autonomous features. NotiQ is a configurable software tool that acts on your instructions and through mailboxes you connect. NotiQ is not the sender of your campaigns.

Your compliance obligations

You alone must ensure that your use of the Service complies with all applicable laws and regulations in every jurisdiction where your recipients are located. That includes anti-spam and marketing rules, ePrivacy and telecom marketing rules, privacy laws (including GDPR and equivalent regimes), consent and opt-in requirements where they apply, and the policies of email and mailbox providers. Contact details or public business listings obtained through the Service do not by themselves constitute consent or a lawful basis to send email.

Autonomous and AI-assisted sending

If you enable auto-send, AI agents, or other features that create, schedule, or send messages without you reviewing each one, you authorize those sends, are deemed to have approved them, and remain fully responsible for them. Choosing not to review messages before they are sent does not shift any responsibility or liability to NotiQ.

Optional safeguards

Features that may help with pacing, review-before-send, unsubscribe handling, exclusions, email verification, or similar controls are optional aids only. They do not guarantee legal compliance, create consent or a lawful basis to contact anyone, or reduce your obligations under these Terms.

Scope of sending channels

These responsibilities apply to all connected sending accounts and channels you use with the Service, including Gmail, Outlook, IMAP/Email, and any other providers we support now or in the future—not only Gmail.

User Accounts and Registration

To use certain features of the Service, you must register for an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your password and account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

If you connect a sending mailbox (including Gmail, Outlook, IMAP/Email, or another supported provider), you represent that you are authorized to connect and use that mailbox for outreach through NotiQ and that your use will comply with these Terms and our Privacy Policy.

Gmail and Google Services

Certain features require you to connect a Google or Gmail account through Google OAuth. By connecting Gmail, you authorize NotiQ to access and use Google user data as described in our Privacy Policy — Google User Data section, including:

• sending email on your behalf from your connected Gmail account;
• reading Gmail messages only as needed for outreach features such as detecting replies, syncing conversations in the NotiQ inbox, maintaining threading, and identifying delivery failures;
• creating NotiQ-managed label names in Gmail and applying or removing those labels on outreach threads you sent or tagged through NotiQ; and
• reading your Gmail send-as signature when you enable “Use sender's Gmail signature” on an outreach agent.

We do not read your entire Gmail mailbox. We do not change your Gmail filters or general account settings. We do not delete messages or modify labels outside the NotiQ-managed set. OAuth scopes and data handling details are listed in our Privacy Policy.

You agree that:

• You will use Gmail integration only for the user-facing outreach features offered by NotiQ and on your instructions
• You will comply with Google's applicable terms, policies, and API restrictions, including the Google API Services User Data Policy
• You may disconnect Gmail at any time from Accounts in NotiQ and revoke access in your Google Account permissions

NotiQ's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. NotiQ's handling of Google user data is further described in our Privacy Policy — Google User Data section. NotiQ may use third-party AI processing providers (such as OpenAI, Anthropic, or Google) to provide user-facing features you use, including categorizing replies to your outreach and suggesting draft replies. Details are in our Privacy Policy — Google User Data section. We do not use Google user data for advertising or to train generalized AI models.

Subscription and Payment Terms

Billing

• Subscription fees are billed in advance on a monthly or annual basis
• Your first payment is covered by a 30-day money-back guarantee: if NotiQ is not the right fit, contact us within 30 days of your first payment and we will refund that payment in full. Except for that guarantee and as otherwise required by law, fees are non-refundable
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

Cancellation

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• Access to premium features will be removed upon cancellation

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of 2MTN AB (operating as NotiQ) and its licensors. The service is protected by copyright, trademark, and other laws.

• You retain ownership of content you create using the Service
• You grant us a license to use your content (excluding Google user data except as permitted in our Privacy Policy) to provide and improve the Service
• You may not copy, modify, or distribute our proprietary technology

Service Availability and Limitations

While we strive to provide reliable service, we cannot guarantee:

• 100% uptime or uninterrupted access to the Service
• Compatibility with all email providers or systems
• Specific response rates or campaign success metrics
• Continuous availability of third-party integrations (such as Gmail, Outlook, IMAP/Email providers, Google OAuth, or public business listing sources)
• That Google or other third-party providers will continue to make their services available on current terms

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and share information, including Google user data. By using the Service, you agree to our data processing practices as described in the Privacy Policy.

If you connect Gmail, your use of Google user data is also governed by the Google User Data section of our Privacy Policy and the Limited Use requirements described there.

Product and marketing communications

2MTN AB operates ScaliQ, NotiQ and RepliQ. By signing up for any of these products, you agree that, where permitted by applicable law, we may send you relevant product updates, cold outreach strategies, educational content and occasional offers relating to ScaliQ, NotiQ and RepliQ.

You may unsubscribe from marketing communications at any time using the link included in each email or by contacting us. Unsubscribing will not affect essential account, security, billing or service-related communications.

Indemnification

You agree to defend, indemnify, and hold harmless 2MTN AB (operating as NotiQ) and its officers, directors, employees, and agents from and against any third-party claims, investigations, fines, penalties, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your campaigns, targeting, content, recipient lists, use of the Service, or failure to comply with applicable law or these Terms.

Limitation of Liability

To the maximum extent permitted by law, 2MTN AB and NotiQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Service.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service, applicable law, or third-party policies (including Google API policies), or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ends. Disconnection, retention, and deletion of data (including Google user data) are handled as described in our Privacy Policy.

Governing Law

These Terms shall be interpreted and governed by the laws of Sweden, without regard to conflict of law provisions.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. If changes are material, we will notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
