Terms of Service

Agreement to Terms

By accessing and using NotiQ ("Service"), provided by 2MTN AB, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

Description of Service

NotiQ is an AI-powered outreach platform that helps you find business leads, generate personalized outreach content, and send email campaigns from Gmail accounts you connect. Depending on how you use the Service, this may include retrieving public business listing information for lead discovery, importing or managing prospect data, creating AI-assisted email copy, sending outreach through connected Gmail accounts, and tracking replies and engagement in the NotiQ inbox.

NotiQ is designed as a productivity tool for authorized business outreach. You are responsible for ensuring your use of the Service complies with applicable laws and the policies of any third-party services you connect, including Google and Gmail.

Acceptable Use Policy

You agree to use the Service responsibly and in compliance with all applicable laws, including anti-spam, privacy, and marketing regulations. You must not:

  • Send spam, unsolicited emails, or engage in outreach without a lawful basis or appropriate consent where required
  • Violate applicable anti-spam or marketing laws (such as CAN-SPAM, GDPR, or equivalent local rules)
  • Use the Service for illegal activities, fraud, harassment, or deceptive practices
  • Attempt to reverse engineer, hack, or compromise our systems or connected third-party services
  • Share your account credentials or connected mailbox access with unauthorized users
  • Collect or use personal data about prospects or recipients without a lawful basis and appropriate notice where required
  • Send threatening, abusive, or inappropriate communications
  • Use the Service in a way that violates Google's terms, policies, or API restrictions, including the Google API Services User Data Policy
  • Misuse Gmail or other connected accounts, exceed reasonable sending limits, or engage in conduct that may harm sender reputation or violate provider policies

You are solely responsible for the content of emails you send through NotiQ, your recipient lists, and providing appropriate notice to recipients about your outreach and any tracking you enable, where required by law.

User Accounts and Registration

To use certain features of the Service, you must register for an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your password and account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

If you connect a Gmail account, you represent that you are authorized to connect and use that mailbox for outreach through NotiQ and that your use will comply with these Terms and our Privacy Policy.

Gmail and Google Services

Certain features require you to connect a Google or Gmail account through Google OAuth. By connecting Gmail, you authorize NotiQ to access and use Google user data as described in our Privacy Policy — Google User Data section, including sending email on your behalf and reading Gmail messages only as needed for outreach features such as detecting replies, maintaining threading, and identifying delivery failures. We do not read your entire Gmail mailbox, and we do not access or modify Gmail settings, filters, or labels.

You agree that:

  • You will use Gmail integration only for the user-facing outreach features offered by NotiQ and on your instructions
  • You will comply with Google's applicable terms, policies, and API restrictions, including the Google API Services User Data Policy
  • You may disconnect Gmail at any time from Accounts in NotiQ and revoke access in your Google Account permissions

The use of information received from Google Workspace APIs will adhere to the Google User Data Policy, including the Limited Use requirements. NotiQ's handling of Google user data is further described in our Privacy Policy. NotiQ may use third-party AI processing providers (such as OpenAI, Anthropic, or Google) to provide user-facing features you use, including categorizing replies to your outreach and suggesting draft replies. Details are in our Privacy Policy — Google User Data section. We do not use Google user data for advertising or to train generalized AI models.

Subscription and Payment Terms

Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension

Cancellation

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of your current billing period
  • Access to premium features will be removed upon cancellation

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of 2MTN AB (operating as NotiQ) and its licensors. The service is protected by copyright, trademark, and other laws.

  • You retain ownership of content you create using the Service
  • You grant us a license to use your content (excluding Google user data except as permitted in our Privacy Policy) to provide and improve the Service
  • You may not copy, modify, or distribute our proprietary technology

Service Availability and Limitations

While we strive to provide reliable service, we cannot guarantee:

  • 100% uptime or uninterrupted access to the Service
  • Compatibility with all email providers or systems
  • Specific response rates or campaign success metrics
  • Continuous availability of third-party integrations (such as Gmail, Google OAuth, or public business listing sources)
  • That Google or other third-party providers will continue to make their services available on current terms

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, store, and share information, including Google user data. By using the Service, you agree to our data processing practices as described in the Privacy Policy.

If you connect Gmail, your use of Google user data is also governed by the Google User Data section of our Privacy Policy and the Limited Use requirements described there.

Limitation of Liability

To the maximum extent permitted by law, 2MTN AB and NotiQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Service.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service, applicable law, or third-party policies (including Google API policies), or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ends. Disconnection, retention, and deletion of data (including Google user data) are handled as described in our Privacy Policy.

Governing Law

These Terms shall be interpreted and governed by the laws of Sweden, without regard to conflict of law provisions.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. If changes are material, we will notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
